The Hawaii
Territorial Legislature adopted the first Workers'
Compensation (WC) Law which took effect on
July 1, 1915. The WC Law required the employer
to provide certain benefits to the employee
without regard to the fault of the employer.
At the same time, the employee was prohibited
from filing civil actions (lawsuits) against
his/her employer for work-related injuries
or illnesses. The WC Law was Hawaii's first "no-fault" legislation.
Under the present law, an employee sustaining
a work-related injury or illness is entitled
to medical treatment, wage loss benefits, permanent
disability, disfigurement and death benefits.
